This section applies when an Authorized Educational Institution permits students, including students under the age of 18, to access designated educational portions of the Platform through an Educational Program. “Student Personal Information” means personal information that Tekmetric receives from, about, or relating to a student through an Educational Program, including information provided by the Authorized Educational Institution, the student, or an authorized parent or legal guardian.
Our Role
For an Educational Program, the Authorized Educational Institution is responsible for determining the purposes and means of the student’s use of the Platform and for providing all required notices and obtaining all required consents, permissions, and authorizations. Tekmetric will process Student Personal Information only to provide, secure, support, maintain, and improve the Educational Program and the Platform; comply with applicable law; and as otherwise permitted by any applicable written agreement with the Authorized Educational Institution. Tekmetric will not use Student Personal Information to train artificial-intelligence models. To the extent applicable law characterizes the parties’ roles differently, Tekmetric will act in the role required by applicable law.
Information We Collect
Depending on the Educational Program and the features enabled by the Authorized Educational Institution, we may collect Student Personal Information such as the student’s name, school-issued email address or user identifier, grade level or program affiliation, login and account information, use and activity information, communications submitted through authorized Platform features, educational or training records entered into the Platform, device and browser information, IP address, and security-log information. We do not require students to provide payment-card information or a personal telephone number to participate in an Educational Program, and Educational Program accounts do not include marketing text-message functionality unless authorized by the Authorized Educational Institution and permitted by applicable law.
How We Use Student Personal Information
We use Student Personal Information only as reasonably necessary to:
- provide, operate, secure, troubleshoot, and support the Educational Program and Platform;
- authenticate users, administer school-managed accounts, and prevent fraud, misuse, and security incidents;
- comply with law, enforce applicable agreements and policies, and protect the rights, safety, and security of Tekmetric, the Authorized Educational Institution, students, and others;
- communicate with the Authorized Educational Institution and its authorized personnel regarding the Educational Program; and
- create and use aggregated or de-identified information, where permitted by applicable law, for analytics, product improvement, and other lawful business purposes, provided that the information does not identify a student or reasonably permit a student to be identified.
We will not use Student Personal Information obtained through an Educational Program to engage in targeted behavioral advertising to students, build a profile of a student for non-educational purposes, sell Student Personal Information, train artificial-intelligence models, or use Student Personal Information for any purpose unrelated to the Educational Program, except as permitted by applicable law or any applicable written agreement with the Authorized Educational Institution.
Children Under 13; School Authorization
Tekmetric does not knowingly permit a child under age 13 to create an independent Platform account. An Authorized Educational Institution may authorize a child under age 13 to use the Educational Program only where the Authorized Educational Institution has provided any notice and obtained any consent required by applicable law, including the Children’s Online Privacy Protection Act (“COPPA”). Where permitted by COPPA, Tekmetric will rely on the Authorized Educational Institution to provide consent on behalf of a parent or legal guardian solely for the collection and use of Student Personal Information necessary to provide the Educational Program. Parents and legal guardians who have questions about a child’s participation in an Educational Program should first contact the Authorized Educational Institution. Tekmetric will reasonably cooperate with the Authorized Educational Institution in responding to verified requests as required by applicable law or any applicable written agreement.
How We Disclose Student Personal Information
We may disclose Student Personal Information only: (a) to the Authorized Educational Institution and its authorized administrators, instructors, and personnel; (b) to service providers and subprocessors that provide services for Tekmetric and are contractually required to use the information only to provide services to Tekmetric and protect it with appropriate safeguards; (c) when required by law, regulation, subpoena, court order, or other valid legal process; (d) when reasonably necessary to protect the security or integrity of the Platform or the rights, property, health, or safety of Tekmetric, the Authorized Educational Institution, students, or others; (e) in connection with a corporate transaction, subject to applicable law and confidentiality protections; or (f) as otherwise authorized by the Authorized Educational Institution or required by applicable law.
We do not disclose Student Personal Information to third parties for their own marketing or promotional purposes. We do not share a student’s SMS opt-in information or consent with third parties for their own marketing or promotional purposes.
Security
Tekmetric maintains reasonable administrative, technical, and physical safeguards designed to protect Student Personal Information against unauthorized access, use, loss, alteration, and disclosure. No security measure is absolute, and no method of transmitting or storing information is completely secure. In the event of a security incident involving Student Personal Information, Tekmetric will notify and cooperate with the Authorized Educational Institution as required by applicable law and any applicable written agreement.
Retention and Deletion
We retain Student Personal Information for as long as necessary to provide the Educational Program, comply with our legal obligations, resolve disputes, enforce our agreements, and meet our legitimate operational and security needs, unless a different period is required by applicable law or any applicable written agreement. Upon termination or expiration of an Educational Program, Tekmetric will return or delete Student Personal Information as required by applicable law or any applicable written agreement, except to the extent retention is required by law or the information is retained in secure backup systems and deleted in accordance with Tekmetric’s backup-retention practices.
Rights and Requests
Requests to access, correct, delete, or obtain Student Personal Information should be submitted through the Authorized Educational Institution, which can verify the requester’s authority and coordinate with Tekmetric. Tekmetric will provide reasonable assistance to the Authorized Educational Institution in responding to requests as required by applicable law or any applicable written agreement. Parents, legal guardians, and eligible students may also have rights under applicable privacy laws; nothing in this Privacy Policy limits rights that cannot legally be waived.
Conflict
If this section conflicts with another provision of this Privacy Policy as applied to Student Personal Information processed through an Educational Program, this section controls. If this section conflicts with an applicable written agreement between Tekmetric and an Authorized Educational Institution, the written agreement controls to the extent of the conflict.
